Statistics for eDiscovery: The Family Impact of Document Responsiveness in eDiscovery Sampling
A document may be found responsive because one of its family members is responsive. How do we deal with that situation statistically?
The relationship between documents and document families does not present any particular challenge for statistics or sampling. Suppose that we are doing a statistical comparison between two groups, for example, between the responsiveness predictions from a computer and the corresponding judgments of human reviewers. What is important is that we use the same unit of analysis for both. The proper unit of analysis, in turn, will depend on the available data. If you have element-level (i.e., emails and each attachment are judged separately) judgments from your human reviewers then you can compare at the element level or the family level. If you only have family- level judgments, then you will need to compare at the family level
